1. General Provisions
1.1. This document is the official public offer of Lunagroup A LLC (hereinafter — "Seller") and contains all material terms of a retail sale agreement for goods sold remotely, concluded with any legally capable individual or legal entity (hereinafter — "Buyer") in accordance with Articles 367–370 of the Civil Code of the Republic of Uzbekistan and the Law of the Republic of Uzbekistan "On Consumer Protection".
1.2. Acceptance of this offer is the Buyer placing an order on the website lunaflowers.uz and/or paying for the order by any of the available methods. By accepting, the Buyer confirms that they have fully read the terms of this offer, understand and accept them in full without any exceptions or reservations.
1.3. The Seller reserves the right to unilaterally amend this offer. Amendments take effect upon publication on lunaflowers.uz and do not apply to orders placed and paid before the publication of such amendments.
1.4. The agreement is considered concluded upon acceptance of the offer and remains in effect until both parties have fulfilled their obligations.
2. Terms and Definitions
"Site" — the online store located at https://lunaflowers.uz.
"Goods" — bouquets, floral arrangements, flowers and related products listed in the Site catalogue.
"Order" — a duly placed request by the Buyer to purchase and have delivered (or self-collect) selected Goods.
"Recipient" — the person designated by the Buyer to receive the Order.
3. Subject of the Agreement
3.1. The Seller undertakes to transfer to the Buyer (Recipient) the Goods of proper quality, and the Buyer undertakes to accept and pay for the Goods on the terms of this offer.
3.2. Images of the Goods on the Site are for illustration purposes. As flowers are a natural product, the appearance of a bouquet may slightly differ from the image (shade, degree of bloom, seasonal substitution of individual flowers with equivalents of equal quality and value, with the Buyer's agreement). Such differences do not constitute a defect in the Goods.
4. Order Placement
4.1. The Buyer places an order independently on the Site by selecting Goods from the catalogue, adding them to the cart and completing the order form, or by contacting the Seller's operator using the contact details provided on the Site.
4.2. When placing an Order, the Buyer provides:
– first and last name and contact phone number of the Buyer;
– name, phone number and address of the Recipient (for delivery);
– desired delivery date and time or self-collection date and time;
– payment method;
– where applicable — card message text and additional instructions.
4.3. After the Order is placed, the Buyer receives a confirmation (on the Site, by phone, SMS, email or messenger) including the Order contents, total amount, and delivery/self-collection date and time. The Order is deemed accepted for fulfilment after confirmation by the Seller and receipt of payment.
4.4. The Buyer is responsible for the accuracy of information provided when placing the Order. The Seller is not liable for inability to fulfil the Order due to inaccurate or incomplete information provided by the Buyer.
5. Price and Payment
5.1. Prices for the Goods are listed on the Site in the national currency of the Republic of Uzbekistan — UZS (soum). The price of the Goods is valid at the time the Order is placed. Delivery charges (if any) are shown separately at checkout.
5.2. Payment is made in full prepayment by one of the following methods:
– Uzcard, Humo, Visa, Mastercard bank cards via the Payme payment system;
– bank cards via the Click payment system;
– bank cards via the Freedom Pay payment system.
5.3. Payment by bank card: upon selecting the relevant payment method, the Buyer is redirected to the secure payment page of the selected payment system (Payme, Click or Freedom Pay), where they enter their card details (card number, expiry date) and confirm the payment with a one-time code (SMS code / app code) sent by the issuing bank.
5.4. Data transmitted on the payment page is protected by encrypted connection. The Seller does not receive, process or store the Buyer's full card details; payment processing is carried out by licensed and certified payment systems and banks.
5.5. The Order is considered paid upon receipt of funds in the Seller's account or upon payment confirmation by the payment system. If payment is not received within the time specified at checkout, the Order may be cancelled by the Seller.
5.6. An electronic receipt or other payment confirmation document is provided to the Buyer upon request.
6. Delivery and Handover
6.1. Delivery is made to the address specified by the Buyer on the agreed date and within the agreed time window, or the Order is handed over to the Buyer (Recipient) at the Seller's pick-up point.
6.2. If the Recipient is not at the specified address at the agreed time, the courier contacts the Buyer to agree on further steps. Re-delivery may be subject to an additional charge.
6.3. Upon receipt, the Recipient must inspect the Order for appearance and completeness. Claims regarding appearance and completeness raised after the Order has been handed over will be reviewed by the Seller individually in accordance with Section 7 of this offer.
7. Return Policy
7.1. Please note: all purchases are final — Goods are not eligible for return or exchange. Flowers and floral arrangements are perishable goods of satisfactory quality which, under the laws of the Republic of Uzbekistan, are not subject to return or exchange.
7.2. The Seller carefully inspects each item before dispatch to ensure its quality and full compliance with the Site description.
7.3. If, upon receipt, the Order shows obvious defects (discrepancy with the Order contents, loss of presentable appearance due to the fault of the Seller or courier), the Buyer (Recipient) must document the defects (photo/video) at the time of receipt and contact the Seller using the contact details on the Site immediately at the same day after receipt.
7.4. If the Buyer has any questions or concerns regarding the Order, they may contact the Seller — the Seller will make every effort to find a suitable solution (replacement of Goods, modification of the arrangement or another mutually agreed solution). Buyer satisfaction is the Seller's priority.
8. Order Cancellation Policy
8.1. The Buyer may cancel an Order by notifying the Seller using the contact details on the Site no later than 24 (twenty-four) hours before the agreed delivery or self-collection time.
8.2. If less than 24 hours remain before the agreed delivery or self-collection time, cancellation and refund are not possible, as the Seller will have commenced fulfilment of the Order (purchasing and assembling the floral arrangement for the specific Order).
8.3. The Seller may cancel an Order if it is unable to fulfil it (including due to stock unavailability), notifying the Buyer accordingly. In this case, 100% of the amount paid is refunded to the Buyer in accordance with Section 9 of this offer, or a substitute is arranged by mutual agreement.
9. Refund Policy
9.1. Refunds are made in the following cases:
– Order cancelled by the Buyer no later than 24 hours before the agreed delivery or self-collection time (clause 8.1) — 100% refund;
– Order cancelled by the Seller due to inability to fulfil (clause 8.3) — 100% refund;
– Confirmed material discrepancy of the delivered Goods from the Order, where the parties have not agreed on a replacement or other resolution (Section 7).
9.2. Refunds are made by the same method used for payment — to the same bank card and via the same payment system (Payme, Click, Freedom Pay) used to pay for the Order. Cash refunds for non-cash payments are not made.
9.3. The refund period is up to 10 (ten) banking days from the date the Seller confirms the refund, depending on the rules of the payment system and the Buyer's issuing bank. The Seller is not responsible for the time taken by the issuing bank to credit funds after the Seller has fulfilled its refund obligations.
9.4. To request a refund, the Buyer sends a request to the Seller stating the Order number, payment date and reason for the refund using the contact details on the Site.
9.5. If an Order is cancelled less than 24 hours before the agreed delivery or self-collection time, no refund is made (clause 8.2).
10. Liability
10.1. The parties are liable for non-performance or improper performance of obligations under this agreement in accordance with the laws of the Republic of Uzbekistan.
10.2. The Seller is not liable for damage caused to the Buyer due to improper use of the Goods, or for non-fulfilment of the Order due to inaccurate information provided by the Buyer or the unavailability of the Recipient.
10.3. The parties are released from liability for non-performance of obligations due to force majeure circumstances.
11. Personal Data
11.1. By placing an Order, the Buyer consents to the processing of their personal data (and confirms that the Recipient's consent has been obtained) for the purposes of performing this agreement, in accordance with the Law of the Republic of Uzbekistan "On Personal Data" (ZRU-547). Personal data is used solely for the placement, payment and delivery of Orders and is not transferred to third parties except as necessary for Order fulfilment (courier services, payment systems) or as required by law.
12. Final Provisions
12.1. All disputes and disagreements shall be resolved through negotiation. If no agreement is reached, the dispute shall be submitted to the court at the Seller's location in accordance with the laws of the Republic of Uzbekistan.
12.2. Recognition of any individual provision of this offer as invalid shall not affect the validity of the remaining provisions.
