1. General Provisions
1.1. This User Agreement ("Agreement") governs the terms of use of the website https://lunaflowers.uz ("Site") owned by Lunagroup A LLC ("Administration").
1.2. Any visit to the Site, registration on it, or any other action constitutes the User's full and unconditional acceptance of the terms of this Agreement, as well as the Privacy Policy and Public Offer published on the Site.
1.3. If the User does not agree with the terms of the Agreement, they must immediately cease using the Site.
1.4. The Administration may amend this Agreement unilaterally at any time. Amendments take effect upon publication on the Site. Continued use of the Site after amendments are published constitutes the User's agreement to the updated Agreement.
2. Terms and Definitions
"User" — any legally capable individual aged 18 or over who accesses the Site via the internet.
"Site" — the internet resource located at https://lunaflowers.uz, including all its pages, sections, mobile version and API.
"Administration" — Lunagroup A LLC, TIN 313 078 551, owner and operator of the Site.
"Personal Account" — the secured section of the Site available to a registered User after logging in.
"Content" — any materials published on the Site: texts, images, photographs, logos, product descriptions, design and other intellectual property objects.
"Order" — a request placed by the User to purchase goods in accordance with the terms of the Public Offer.
3. Access to the Site
3.1. Access to the Site is provided free of charge. Registration is not required to browse the catalogue or view information. Orders may be placed with or without registration.
3.2. To create a Personal Account, the User provides a valid email address or phone number and sets a password. The User is fully responsible for the security of their credentials and for all actions performed under their account.
3.3. Upon discovering unauthorised use of their account, the User must immediately notify the Administration at support@lunaflowers.uz.
3.4. The Administration may block or delete a User's account without prior notice in the event of a violation of this Agreement or the laws of the Republic of Uzbekistan.
4. Rules of Use
4.1. The User is entitled to:
– browse the product catalogue and review information about the Administration;
– place orders and use other services of the Site;
– leave reviews in accordance with the rules established by the Administration.
4.2. The User is prohibited from:
– using the Site for purposes contrary to the laws of the Republic of Uzbekistan or this Agreement;
– copying, distributing, reproducing or otherwise using the Site's Content without the written consent of the Administration;
– using automated tools (bots, scrapers, scripts) to collect data from the Site without the Administration's consent;
– interfering with the Site's operation or attempting to gain unauthorised access to its servers or databases;
– publishing on the Site any information that infringes third-party rights, contains spam, false information or offensive material;
– providing knowingly false information when placing an order or registering.
5. Orders and Payment
5.1. The procedure for placing orders and the terms of payment, delivery, cancellation and return of goods are governed by the Public Offer for the conclusion of a remote retail sale agreement, published on the Site at https://lunaflowers.uz/page/public_offer. This Agreement does not cancel or replace the terms of the Public Offer.
5.2. Payment is made exclusively by non-cash means via the Payme, Click and Freedom Pay payment systems. The Administration does not store or process the User's bank card details — these are processed by authorised payment systems.
5.3. By accepting this Agreement, the User confirms that they have read the Public Offer and accept its terms when placing any order.
6. Intellectual Property
6.1. All objects published on the Site — design, texts, photographs, logos, trademarks, software code and other materials — are intellectual property of the Administration or rights holders who have granted the Administration the relevant rights, and are protected by the intellectual property laws of the Republic of Uzbekistan.
6.2. This Agreement does not grant the User any rights to use the Administration's intellectual property, except the right to view Site pages for personal non-commercial purposes.
6.3. By posting reviews or other materials on the Site, the User grants the Administration a royalty-free, non-exclusive, perpetual licence to use such materials for the purposes of operating the Site and marketing activities.
7. Personal Data and Confidentiality
7.1. Processing of the User's personal data is carried out in accordance with the Law of the Republic of Uzbekistan "On Personal Data" (ZRU-547) and the Privacy Policy published at https://lunaflowers.uz/page/privacy_policy.
7.2. Use of the Site and placement of an order constitutes the User's consent to the processing of their personal data for the purposes of performing the sale agreement, improving service quality and marketing communications (subject to the relevant consent).
7.3. The Administration takes organisational and technical measures to protect Users' personal data against unauthorised access, modification, disclosure or destruction. Payment card data is not stored by the Administration.
7.4. The User may withdraw their consent to the processing of personal data at any time by sending a request to support@lunaflowers.uz. Withdrawal of consent does not affect the lawfulness of processing carried out before its receipt.
8. Use of Cookies
8.1. The Site uses cookies and similar technologies to ensure the Site's correct operation, visitor analytics and content personalisation. By using the Site, the User agrees to the use of cookies in accordance with the Privacy Policy.
8.2. The User may disable cookies in their browser settings. Disabling certain categories of cookies may affect the Site's functionality.
9. Liability and Limitation of Liability
9.1. The Administration provides the Site on an "as is" basis and does not guarantee uninterrupted, error-free operation of the Site. The Administration is not liable for temporary unavailability of the Site due to technical maintenance, failures at internet service providers or other causes beyond the Administration's control.
9.2. The Administration is not liable for losses arising from:
– unauthorised access by third parties to the User's account through the User's fault;
– the User's use of links to third-party websites posted on the Site;
– the User's provision of false information when registering or placing an order;
– force majeure circumstances.
9.3. In any event, the Administration's liability is limited to the amount paid by the User for the specific Order in connection with which the dispute arose.
10. Dispute Resolution
10.1. All disputes and disagreements arising in connection with use of the Site or this Agreement shall be resolved through negotiation. If no agreement is reached within 30 (thirty) calendar days of submitting a written claim to support@lunaflowers.uz, the dispute shall be referred to the court at the Administration's location in accordance with the laws of the Republic of Uzbekistan.
10.2. This Agreement is governed by the laws of the Republic of Uzbekistan. Matters not regulated by this Agreement shall be governed by the Civil Code of the Republic of Uzbekistan and the Law "On Consumer Protection".
11. Final Provisions
11.1. If any provision of this Agreement is found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
11.2. The Administration's failure to act in response to a User's violation of the Agreement does not deprive the Administration of the right to take appropriate measures at a later time.
11.3. This Agreement is drawn up in Russian. In the event of discrepancies between versions of the Agreement in different languages, the Russian version shall prevail.
